In this application, the petitioners have prayed for initiation of a contempt proceeding against the opposite parties for willful and deliberate violation of the order dated 10.04.2023 of this Court passed in W.P.(S) No. 4458 of 2021. It has been submitted by the learned counsel for the petitioners that so far as the petitioner no. 1 is concerned, a majority of the death cum pensionary benefits have been extended to the petitioner no. 1 save and except the family pension. So far as petitioner no. 2 is concerned, it has been submitted that the application was made beyond the stipulated period of five years which has been rejected by the authorities concerned. Mr. Indranil Bhaduri, learned SC-IV for the opposite parties has submitted that the obstacles with respect to sanctioning the family pension is concerned is with respect to the change in the name of the petitioner no. 1 in the Aadhar Card for which a Gazette notification has to be issued Neutral Citation No. ( 2025:JHHC:20455 ) -2- and in fact there has been full cooperation from the department in ensuring that necessary Aadhar Card and Pan Card of the petitioner no. 1 are submitted so that the department concerned can facilitate the payment of family pension to the petitioner no. 1. So far as the petitioner no. 2 is concerned, it has been submitted that in terms of the order dated 03.03.2025 passed by this Court necessary instruction has been taken which finds place in the supplementary show cause, from which, it appears that the government had rejected the claim for compassionate appointment of the petitioner no. 2 since it was beyond the stipulated period of five years. On consideration of the submissions advanced by the learned counsel for the respective parties it appears that there has been sufficient compliance of the order dated 10.04.2023 passed in W.P.(S) No. 4458 of 2021 and consequently, I am not inclined to proceed further in this contempt application which accordingly stands disposed of. However, the petitioner no. 2 is at liberty to redress his grievance with respect to compassionate appointment in an appropriate proceeding. (Rongon Mukhopadhyay, J.) Alok/-
