JUDGMENT
Appellant/wife has filed this appeal under Section 19 of the Family Court Act challenging
judgment dated 13.12.2021 passed by learned Principal Judge, Family Court, Dehradun in O.S. No.404/2016, whereby Suit for divorce filed by husband, was
decreed.

Today, both the parties are physically present in Court along with their respective counsels.

Learned counsels appearing for the parties submit that parties have settled their dispute and the terms of settlement have been reduced into writing in compromise affidavits filed by both husband and wife. 1

As per the terms of compromise enumerated in paragraph no.8 of the affidavit filed by the appellant, respondent/husband would pay a sum of ₹12 lakh to the appellant/wife (Anjana Raturi @ Anjana Bhatt) towards the full and final settlement of all her claims including streedhan, maintenance (present, past and future) and permanent alimony and dowry articles.

A bank draft amounting to ₹12 lakh, photocopy whereof is enclosed as Annexure No.1 to the compromise affidavit filed by respondent, was handed over in Court by Mr. Ajay Raturi/respondent to appellant /Anjana Raturi @ Anjana Bhatt.

In paragraph no.8 (e) of the affidavit filed by appellant, it is mentioned that custody of daughter Advika Raturi will be with appellant/wife and respondent/husband will not interfere in any manner whatsoever in her upbringing and all the medical responsibilities of the daughter will be taken care of by the appellant/wife.

Mr. Dharmendra Barthwal, learned counsel appearing for the appellant/wife assures that appellant shall withdraw all criminal cases, instituted by her before different forums. 2

The parties appearing in person before the Court also submitted that since they have decided to part ways and all disputes between them have now been resolved, therefore, this appeal be decided in terms of the compromise. Learned counsel for the parties also made similar submission.

In such view of the matter, the first appeal is decided in terms of the compromise arrived at between the parties, terms whereof have been enumerated in paragraph no.8 of the affidavit filed by the appellant, which shall be part of the decree.
