Neutral Citation No. - 2025:AHC:42061 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 2747 of 2025 Petitioner :- Dinesh Kumar And 10 Others Respondent :- Jagveer Nagar And 6 Others Counsel for Petitioner :- Daya Shanker Pandey Hon'ble Rohit Ranjan Agarwal,J. This is the defendants' petiton. In the suit instituted by the plaintiff-respondent No.1, the application for grant of temporary injunction was moved which was rejected by the trial Court. Against the said order, the plaintiff had preferred misc. appeal No.9 of 2025, which is pending consideration. Learned counsel for the petitioner submits that after filing of the misc. appeal before the Court below, the plaintiff had moved an application under Section 151 C.P.C. and on the same day, the Court below had proceeded to pass the order of status quo. Looking to the gravity of the matter, this Court finds that no useful purpose would be served in keeping the matter pending or calling for counter affidavit after issuing notice to other side. As the appeal is pending before the District Judge, Hapur, the writ petiton is disposed of requesting the District Judge, Hapur, to proceed with the Misc. Appeal No.9 of 2025 and decide the same, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. It is made clear that this Court has not adjudicated the case on merit. Order Date :- 21.3.2025 Kushal Digitally signed by :- KUSHAL AGRAWAL High Court of Judicature at Allahabad
