….Respondents ____________________________________________________________
Coram: Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? 1 For the Petitioner: Mr. Narender Singh Thakur, Advocate. For the Respondents: Mr. Rajan Kahol and Mr. Vishal Panwar, Additional Advocates General, with Mr. Ravi Chauhan, Deputy Advocate General, for State. ____________________________________________________________ Sandeep Sharma, Judge (oral): Petitioner herein, who at present is working as Assistant Sub- Inspector at Police Line Nahan, District Sirmaur, H.P., has approached this Court in the instant proceedings seeking directions to respondents to consider and decide his pending representation (Annexure P-2), whereby he has prayed for his transfer from afore station to one of the station, as detailed in the prayer clause, against vacant post, on medical grounds, in time bound manner.
2. It is averred in the petition, which is duly supported by way of affidavit that petitioner at present is suffering from serious disease whereby his intestines have already been removed and he has to further undergo surgery for installments of stents. Superintendent of Police, Nahan, has already recommended the case of the petitioner for transfer from Nahan to one of the station, as detailed in the prayer clause, but same is pending 1Whether the reporters of the local papers may be allowed to see the judgment?

consideration before the Director General of Police, as is evident from the communication dated 27.09.2025 (Annexure P-3).
3. While putting in appearance on behalf of respondents, learned Additional Advocate General fairly states that representation, if not already decided, shall be decided expeditiously in accordance with law.
4. True it is that Police officials are part of essential services and cannot seek transfer to the station of his/her choice, but once it is apparent from the material adduced on record that petitioner is unwell, as a result thereof, he requires constant care and attention of family members, coupled with the fact that Superintendent of Police, Nahan, having noticed the gravity of the situation, has already recommended the case of the petitioner to Director General of Police, this Court sees no impediment inasmuch as issuing directions to Director General of Police to consider and decide the pending representation of the petitioner expeditiously, preferably, within a period of two weeks. Ordered accordingly. Needless to say, authority concerned while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders. Pending application(s), if any, also stands disposed of. (Sandeep Sharma), Judge October 15, 2025 (Rajeev Raturi)
