W.P.No.21890 of 2018 was filed to declare the proceedings in Lr.No.CLU/470/2018 dated 09-05-2018 issued by the 2nd respondent herein and consequential proceedings in Lr.No.Re.EE3-134418/2016 dt.06-06-2018 issued by the 3rd respondent herein permitting construction of ELSR ( Elevated Level Reservoir) of 1500 KL in Sy.No.325/3,4 and 327/3 of Nagarjuna Nagar, Vijayawada, which is a residential area, as illegal and arbitrary. 2. W.P.No.33018 of 2018 was filed to declare the Memo No. MAU01- 28029/104/2018-M SEC-MAUD(M2), dated 23-08-2018 issued by 1st respondent permitting the 3rd respondent to utilize the site of 576 sq.meters located in South-West corner in the Nagarjuna Nagar Colony, Patamata, Vijayawada for construction of 1500 KL capacity Elevated Level Reservoir (ELSR) as illegal, and arbitrary. 3. When the matters are taken up for hearing, learned counsel for the Petitioners submits that during pendency of these Writ Petitions, the Elevated Level Reservoir was constructed and the same is now functional. He fairly submitted that it would not be appropriate to insist for demolition of the same at this length of time. 4. Considering that the construction of Water Tank is completed, which is for the greater good of the society, this Court does not find any reason to interfere at this point of time. 5. Accordingly, the Writ Petitions are dismissed. There shall be no order as to costs.
