COMMON ORDER:
The instant Criminal Petition is filed by the Petitioners under Section 528 of B.N.S.S., 2023 for the following relief:
“ ... to quash the FIR.No.868/2016 on the file of the Patamata Police Station, Vijayawada City, NTR District in the interest of justice. ...”
IA.No.2 of 2025 is filed under Section 359(6) read with Section 528 of BNSS, 2023, by the Petitioner/de facto Complainant (respondent No.2) seeking permission to compromise the matter with respondents/A.1 to A.3 & A.5 to A.7 by quashing the Proceedings in Crime No.868 of 2016 of Patamata Police Station, Vijayawada city, against the Accused.
IA No.3 of 2025 is filed under Section 359(2) read with 528 BNSS, 2023 requesting to record compromise in Crime No.868 of 2016 of Patamata Police Station, Vijayawada city, for the offences under Sections 498-A read with 34, 109 and 102-B IPC and quash the proceedings against the Accused. 3
Petitioners herein are A.1 to A.3 &A.5 to A.7 in the above crime. It is a matrimonial dispute. The marriage of respondent No.2 with a.1 took place on 14.02.2009 as per the Hindu customs and her parents gave and gold ornaments etc., as per the demand of the accused. Due to disputes between the couple, they lived separately and their marriage was dissolved vide Order dated 14.08.2024 in FCOP No.788 of 2014 on the file of the court of XIV Additional District Judge-cum-Judge Additional Family Court, Vijayawada. Seeking quashment of the Proceedings against them, in the above crime, Petitioners/A.1 to A.3 & A.5 to A.7 filed the present criminal petition. During the pendency of this Criminal Petition, parties made a request before this Court that they intend to compromise the matter and accordingly, directed the parties to appear before the Secretary, High Court Legal Services Committee, High Court of Andhra Pradesh, Amaravati for taking necessary steps. Mediation report is filed, which reveals that respondent No.2 stated that she received all the emoluments from A.1 and she has no objection to settle the matter with the accused. Parties are identified by their respective learned counsels on record. Copies of the Aadhar cards of the parties attested by their respective counsel are filed for proper identification. Learned Assistant Public Prosecutor is in attendance. 4
Respondent No.2 submitted before this Court that she has no issues with the Petitioners and there is no coercion and undue influence for settling the issue with the Petitioners. Considering the submissions, in the interests of justice, I.A.Nos.2 and 3 of 2025 are allowed.
Consequently, this Criminal Petition is allowed and the Proceedings in Crime No.868 of 2016 of Patamata Police Station, Vijayawada city, against Petitioners/A.1 to A.3 & A.5 to A.7 are hereby quashed.
