[2025:RJ-JP:3048] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 4th Bail Application No. 564/2025 Mahadev Meena S/o Late Shri Chanda Lal Meena, Aged About 46 Years, R/o Village Nangalpuran, Police Station Shivdaspura Jaipur. At Present Confined In Central Jail, Jaipur (Rajasthan). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Prahlad Sharma, Adv. For Respondent(s) : Mr. Manvendra Singh, Dy. GA HON'BLE MR. JUSTICE NARENDRA SINGH DHADDHA Order 22/01/2025 1. The 4th bail application has been filed by the petitioner under Section 483 B.N.S.S. in connection with FIR No.420/2021 registered at Police Station Shivdaspura, Jaipur City (South) for the offence under Section 302 IPC (lateron offence under Sections 302, 315, 316 IPC were found to have been made out). 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 23.09.2021. Learned counsel for the petitioner also submits that complainant had not supported the prosecution story. Out of 19 witnesses 10 witnesses have been examined by the trial court. Petitioner is behind the bars for more than 3 years and conclusion of trial may take long time. So, the petitioner be enlarged on bail. 3. Learned counsel for the petitioner has placed reliance upon the following judgments : (1) Zahur Haider Zaidi Vs. Central [2025:RJ-JP:3048] (2 of 2) [CRLMB-564/2025] Bureau of Investigation reported in (2019) 20 SCC 404 and (2) Sagar Tatyaram Gorkhe & Anr. Vs. State of Maharashtra reported in (2021) 3 SCC 725. 4. Learned Dy. GA has opposed the arguments advanced by learned counsel for the petitioner and submitted that petitioner murdered his own daughter who was 13 years old and was pregnant. Learned Dy. GA also submitted that complainant is wife of the petitioner. She has not supported the prosecution story. During investigation, one plastic rope and one bottle of insecticide was recovered from him. So, looking to the gravity of offence, the bail application be dismissed. 5. I have considered the arguments advanced by learned counsel for the petitioner as well as learned Dy. GA. 6. Allegation against the petitioner is that petitioner had forced her 13 years' old pregnant daughter to drink insecticide to terminate her pregnancy. After that, he had throttled her with a rope. During investigation, a plastic rope as well as a bottle of insecticide was recovered from him. So, looking to the gravity of offence, I do not consider it a fit case to enlarge the petitioner on bail. 7. Hence, the 4th bail application stands dismissed. (NARENDRA SINGH DHADDHA),J Jatin /36
