[2025:RJ-JP:24737] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous (Petition) No. 7008/2024 Pradeep Sharma S/o Shri Ram Narayan Sharma, Aged About 32 Years, R/o Ward No. 10, Railway Station , Jugalpura, Kanwat, Thoi, District Sikar, Rajasthan. ----Petitioner Versus 1. State Of Rajasthan, Through Public Prosecutor. 2. Jitendra Verma S/o Nand Lal Verma, R/o Jugalpura, Thoi, District Sikar, Rajasthan. ----Respondents For Petitioner(s) : Mr. C.P. Sharma For Respondent(s) : Mr. J.S. Rathore, PP HON'BLE MR. JUSTICE ANAND SHARMA Order 04/07/2025 By way of filing the instant criminal misc. petition under Section 528 of BNSS, the petitioner has challenged the FIR No. 0255/2022 registered at Police Station Thoi, District Sikar for alleged offences under Sections 323, 341, 452, 504, 382, 506, 34 IPC and Sections 3(1)(r), 3(1)(s) and 3(2) (va) of SC/ST Prevention of Atrocities Act, 1989. Learned counsel for the petitioner would submit that the instant FIR is simply a counterblast by the complainant against the petitioner, as the petitioner has lodged as many as two FIRs against the complainant alleging serious charges against him. Learned counsel for the petitioner would submit that in one of the FIR lodged by the petitioner, charge-sheet has been filed by the police finding cognizable offence against the complainant. [2025:RJ-JP:24737] (2 of 2) [CRLMP-7008/2024] Despite service, nobody appeared on behalf of respondent No.2-complainant. Learned Public Prosecutor opposed the criminal misc. petition. In the facts and circumstances of the case, it would be in the interest of justice to direct the petitioner to submit a representation before the Superintendent of Police, Sikar alongwith documents including cross FIR and supporting facts. In case any such representation is filed, same shall be considered by the Superintendent of Police and necessary directions shall be given to the Investigating Officer to proceed further in accordance with law. In case, any case is made out against the petitioner then before taking any adverse action, notice of 14 days shall be given to the petitioner. In the light of above, the instant criminal misc. petition is disposed of. (ANAND SHARMA),J NEERU/163
