The instant criminal petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioner/Accused, against the docket order dated 06.08.2025 passed by the learned I Additional Judicial Magistrate of First Class, Razole, in C.C.No.1696 of 2022.
2. Heard Sri M Yuva Siva Swamy, learned counsel for the Petitioner and Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent No.1/State.

Learned counsel for the petitioner would submit that a Non-Bailable Warrant was initially issued against the petitioner as she was unable to appear before the trial Court on the date of adjournment. Learned counsel would further submit that the learned trial Judge dismissed the petition filed to condone the petitioner's absence on the ground that the conditional order was not complied with, and accordingly, issued the NBW. The matter has been adjourned to 18.09.2025 before the trial Court. Aggrieved by the said order, the present Criminal Petition is filed.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions made, the petitioner is at liberty to file a recall petition before the trial Court. On filing such petition, the learned trial Judge may consider the said petition and fix the conditions to secure the presence of the petitioner for the trial in the said case.
6. With these observations, the Criminal Petition is disposed of. Pending applications, if any, shall stand closed.
