ELEVATED AS JUDGE HON’BLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION No.21157 of 2016 ORDER: The instant writ petition has been filed seeking the following main relief: “to issue an appropriate writ or direction more particularly a Writ in the nature of Mandamus declaring the action of the respondent No. 3 in issuing the proceedings in Rc.No.A1/168/2016 dated 10.04.2016 proposing to retire the petitioner as illegal, arbitrary and unconstitutional and contrary to the Act 4 of 2014 issued by the respondent on 27.6.2014 and set aside the same with a consequential direction directing the respondents to continue the petitioner in service till petitioner completes the age of 60 years with all consequential service benefits ” 2. When the matter is taken up for hearing, learned counsel for the petitioner informed that in view of subsequent events taken place, no further cause survives in the lis and sought for closure of the writ petition. 3. On a perusal of the material on record, this Court finds that no interim orders have been granted as on today. The respondent has filed their counter affidavit inter alia contending that the writ petitioner retired from service on 30.06.2016. 4. Taking into consideration the above specific averment made in counter affidavit as well as the submission that cause in the lis does not survive, this writ petition is closed, as no further orders are necessary.
