Neutral Citation No. - 2025:AHC:41304-DB Court No. - 43 Case :- HABEAS CORPUS WRIT PETITION No. - 218 of 2025 Petitioner :- Smt Sonam Rathaur Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Rakesh Dubey Counsel for Respondent :- G.A. Hon'ble Vivek Kumar Birla,J. Hon'ble Praveen Kumar Giri,J.
1. Heard Sri Rakesh Dubey, learned counsel for the petitioner and Sri Rahul Asthana, learned A.G.A. appearing for the State respondents.
2. Present petition has been filed seeking direction to the respondent nos. 3 and 4 to produce the corpus before this Hon'ble Court.
3. We find that in paragraph 12 of the petition it has been stated that the parents of the corpus have forcefully taken her away.
4. It appears that the present petition has wrongly been placed before us and the same would be cognizable by learned Single Judge.
5. However, at this stage, learned A.G.A. has placed before this Court a copy of the original statement made by the corpus herself (Sonam Rathour) that she had left with her parents without any force and no one has detained her and she is living with them on her own sweet will.
6. In such view of the matter, nothing survives in the petition and the same has become infructuous and there is no need to send the matter before the learned Single Judge.
7. Present petition is accordingly dismissed as having become infructuous.
8. A photocopy of the statement of the corpus as received by learned A.G.A. duly attested by him is taken on record. Order Date :- 21.3.2025 Lalit Shukla Digitally signed by :- LALIT KUMAR SHUKLA High Court of Judicature at Allahabad
