Beawar City, Presently Jawed Road Lines, Ajmer Road Bypass, Police Station Sadar, Beawar (Raj.). JUSTICE ANIL KUMAR UPMAN Order 07/04/2025 1. The bail application under Section 483 of BNSS has been filed, on behalf of the petitioners, who have been arrested in connection with FIR No.238/2024 registered at Police Station Murlipura, District Jaipur (West) (Raj.) for the offences punishable under Sections 420, 406, 467, 468, 471 & 120B of IPC. 2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated in this case. Counsel submits that alleged offences are triable by Magistrate. It is submitted that an agreement was executed between the parties [2025:RJ-JP:15475] (2 of 3) [CRLMB-546/2025] as per which, it was agreed between them that the profit will be shared in a ratio of 30% and 70%, respectively. It is submitted that the entire offence is based on document and same are in possession of Investigating Agency. There are no criminal antecedents against the petitioners. Charge-sheet has been filed and trial will take considerable time in its conclusion. Petitioners are in custody since 20.12.2024 and further custody of the petitioners would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for complainant vehemently opposes the submissions made by learned counsel for the petitioners. Learned counsel for complainant submits that it was stated by the petitioners in writing on the back of the agreement that they would return the money which was fraudulently taken by them from the complainant by 20.09.2022. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by both the parties, as also the fact that there was business relationship between the parties and alleged offences are triable by Magistrate and trial will take considerable time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is directed that accused-petitioners – 1) Ravi Singh Bhati S/o Bhanwar Singh Bhati and 2) Shabuddin S/o Abdul Wahid, shall be [2025:RJ-JP:15475] (3 of 3) [CRLMB-546/2025] released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. The observation made herein above is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J GAUTAM JAIN /94
