JUSTICE SANJEET PUROHIT Order 08/09/2025 1. The present appeal suffers from gross latches and delay of 2213 days. State has provided an explanation on the basis of a judgment passed by this Court on 07.07.2017 and asserted that the said judgment would be fully applicable to the facts of the present case, as they were all decided together by a common order. We are afraid that the State cannot be allowed to take advantage of the slackness. [2025:RJ-JP:35800-DB] (2 of 2) [SAW-15/2022] 2. The application also does not reflect as to what action was taken against the concerned Officer-in-charge who was pursuing the matter before the learned Single Judge. The reasons provided are not satisfactory. 3. The delay of 2213 days cannot be allowed to be condoned, hence, application No.237/2023 filed under Section 5 of Limitation Act is accordingly, dismissed. 4. The present Special Appeal (Writ) also stands dismissed on the ground of delay and latches. 5. All pending application(s), if any, also stand disposed of.
