Bench Sr.No:-13 [3483] IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI APHC010466222025 r" 03^ WRIT PETITION NO: 23670 of 2025 ...Petitioner Pamu Sam Sumedh Vs. ...Respondents The State of Andhra Pradesh and another ********** Sri Pamarthy Rathnakar Smt T. V. Sridevi, learned Standing Counsel for Dr. N.T.R. University of Health Sciences, Vijayawada. Advocate for petitioner Advocate for respondents
CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE ; 8th September 2025 P C : petitioner had applied for admission to the M.B.B.S. Course for the session 2025-2026 in the Management Quota. The petitioner claims that he got himself registered on 02.08.2025 but could not make the payment against the said seat on account of some technical glitch with the system of the University. The stated that although the petitioner telephonically got in touch with the respondent authorities, it did not elicit any appropriate response which led him to submit an e-mail on 11.08.2025. It is said that since no fault lies with the petitioner, the petitioner cannot be denied his right to seek admission against the payment seat.
2. It is
2
Learned counsel for the respondent University, however, states that the
3. assertion made by the petitioner is without any basis more so with regard to there being any technical glitch inasmuch as approximately 4960 students had paid their fee by 04.08.2025 on the same payment gateway as was to be availed by the petitioner. It is stated that according to the rules and the brochure, the petitioner can only be considered in the stray vacancy round against any available seats. We have heard the learned counsel for the parties. We are of the
4. opinion that the procedure prescribed under the brochure as also the rules has to be strictly followed failing which the admission schedule is bound to get disturbed. The assertion of the learned counsel for the petitioner that there was a technical glitch with the system does not inspire confidence inasmuch as students numbering approximately 4960 had successfully made the payment. There is no material on record submitted by the petitioner except the bald assertion that he had approached the university authorities on 02.08.2025 when he first allegedly failed to make the payment and 11.08.2025 when he finally submitted the e-mail.
5. It is not out of place to mention that according to the schedule, the candidates should deposit fee without late fee from 28.07.2025 to 02.08.2025 The schedule and thereafter with late fee on 03.08.2025 and 04.08.2025. having not been followed by the petitioner would not entitle him to any relief in accordance with the rules and the brochure. We do not find any merit in the
■V 3 petition and the same is, accordingly, dismissed. However, the petitioner may be considered, according to the statement made by the learned counsel for the respondent University, in the stray vacancy round against any available seats. No order as to costs. Pending miscellaneous applications, if any, shall stand closed.
