Singh, Advocate holding brief of Sri Neeraj Kumar Pandey, learned counsel for applicant and Sri Ravi Kumar, learned counsel for the informant as well as Sri Sunil Kumar, learned A.G.A. for the State. 3. The present bail application has been filed by the applicant in Case Crime No.22 of 2025, under Sections 376, 504, 506 I.P.C., 5/6 POCSO Act and 67 I.T. Act, Police Station- Mirzamurad, District- Varanasi with the prayer to enlarge him on bail. 4. Learned counsel for the applicant has pasted certain indecent photographs of the victim in the present bail application. Even the counsel for applicant has procured the said photographs from the applicant by calling them on his own WhatsApp number. A bare perusal of the record indicates that the applicant has misused the said photographs, which were in his exclusive possession. 5. The said act of filing the photographs of victim and applicant by the counsel for applicant is deprecated. 6. The said photographs indicate towards the fact that applicant has indecent photographs of the victim with him, as such, the ingredients of offence mentioned in the FIR stand fulfilled. 7. After hearing learned counsel for the parties and taking into consideration the facts and circumstances of the case, I do not find it a fit case for grant of bail to the applicant. 8. The bail application is found devoid of merits and is, accordingly, rejected. 9. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
