Petitioner was serving as Chief Development Officer in Rural Development Department of the State Government at the time of his retirement. He retired on 31.07.2009. Thereafter, a Government Order was issued by the State Government, whereby pay scale of Chief Development Officer was revised to `37,400-67,000/- Grade Pay `8,700/-. 4. Petitioner has filed this writ petition claiming benefit of the pay revision made in 2010. 5. The stand taken in the counter affidavit was that since petitioner was no more in service, when the Government Order, revising the pay scale, was issued, therefore, petitioner is not entitled to the benefit of pay revision made in 2010. Para no. 2 of the Government Order dated 03.05.2010 clearly 2025:UHC:2008-DB indicates restructuring of cadre of Rural Development Department with immediate effect, and there is nothing to indicate that the said Government Order was applied retrospectively, therefore, petitioner’s claim for revised salary is unsustainable. 6.
