The petitioner has challenged the order passed by District Judge, Korba (C.G.) in Misc. Civil Appeal No. 13/2003 dated 20.07.2023, whereby appeal preferred by the petitioner has been dismissed and the order passed by the Estate Officer dated 13.06.2023 has been affirmed. The petitioner, who was retaining an accommodation under the respondent over encroached land, was directed to vacate the premises. The proceeding under Section 4 of Public Premises (Eviction of Unauthorised Occupants) Act, 1971 was issued and the petitioner was afforded sufficient opportunity and final order was passed by the said Authority on 13.06.2023. The petitioner took a plea that the house was constructed 20 years ago and opportunity of hearing was not Digitally signed by RAMESH KUMAR VATTI Date: 2025.07.14 15:56:23 +0530 2 provided. The subject land was acquired by the SECL, Kusmunda on 19.06.1960. The petitioner failed to produce any document to establish his right over the property, therefore, the Estate Officer passed order of eviction and same has been affirmed by the learned District Judge, Korba. 2. Taking into considering the concurrent findings recorded by two authorities and further the petitioner could not produce any material to establish his right, in my opinion, no case is made out for inference. 3.
