1. In this petition filed under Section 528 of Bhartiya Nagarik Surksha Sanhita, 2023, the applicant seek a direction for early disposal of session trial in Special Criminal Case No. 11/2021 pending before the First Additional District and Sessions Judge, Saraipali, District Mahasamund Chhattisgarh.
2. The facts of the case are that on 23.08.2020, the respondent No. 2 lodged a written report stating that since 2010 the applicant committed forcefully sexual intercourse with her on the pretext SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2025.07.14 14:18:48 +0530
2 of marriage and thereafter denied to perform the marriage and also threatened her not to disclose the incident to her family members. Based on the said report, FIR was registered in Basna Police Station for the aforesaid offence under Secton 376(2)(n), 506 and 323 OF IPC.
3. Learned counsel for the applicant submits that despite the passage of over four years, the trial has not progressed significantly, with only 3 out of 12 witnesses having been examined till date. There are 9 more prosecution witnesses yet to be examined. The prolonged pendency of the trial has caused grave prejudice, mental agony, and hardship to the petitioner. Therefore, the counsel humbly prays that this Court may be pleased to direct the concerned trial Court to expedite the trial proceedings at the earliest possible.
4. Upon perusal of the records reveals that the trial has been pending since 2021 for over four years without significant progress. In veiw of the limited prayer made in this petition and without commenting on the merits of the case, this Court directs the concerned trial Court to conclude the trial in Special Criminal Case No. 11/2021 expeditiously, in accordance with law.
5. With the above observations/direction, this petition stands finally dispose off at the admission stage itself.
