CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : September, 2025 PC : The present writ appeal has been preferred against an order, dated 01.09.2025 passed in WP.No.17601 of 2023.
1. By virtue of the impugned order, the learned single Judge has directed not to evict the petitioner from the house bearing No.74-32/2-5/6, 3'^^ street, Pandaripuram, Vijayawada. 3.
Learned counsel for the appellant would submit that in the guise of the order impugned in the present writ appeal, an impression is gathered as if the petitioner was residing in the house in question and under the protection of the said order, the petitioner would re-enter the house of the appellant.
4. Our attention has been drawn to an earlier order passed in the said writ petition, dated 20.07.2023, wherein the statement given by learned counsel for the petitioner was recorded that the petitioner was not staying with his mother and had left the subject house.
5. Although an effort was made by the counsel appearing for the petitioner before us that the petitioner was in fact staying in one of the portions in the same house, however, the statement recorded earlier by the Court
order, dated 20.07.2023 speaks otherwise and does us of what is stated today. in its not instill confidence in
6. In the normal circumstances we would not entertain a writ appeal against an order which is subject to objections and is good only for two weeks. However, considering the peculiar facts and circumstances of the case, deem it necessary to direct that till such time we as the issue is considered by the learned single Judge on merits, status quo be maintained on spot.
7. Be that as it may, the Writ Appeai is disposed of with a direction to the Registry to iist WP.No.17601 of 2023 after two weeks as directed by the learned singie Judge and tiii such time as the matter is considered on merits.
3 HG &CGR,J WA_962 2025 status quo be maintained with regard to possession on spot. No order as to costs. Miscellaneous applications pending, if any, shall stand closed.
