And 4 Others Counsel for Petitioner :- Hridaya Narain Singh Counsel for Respondent :- C.S.C.,Hari Nath Tripathi Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J.
1. The instant petition, styled as a public interest litigation, has been filed alleging that respondent no. 5, a brick kiln, is being run close to a girls' school, mango garden and other residential structures. Accordingly, prayer has been made for a direction to respondent no. 4, i.e. District Magistrate, Siddharth Nagar, to take action against respondent no. 5 and prohibit its running.
2. Sri J.N. Maurya, learned counsel appearing on behalf of U.P. Pollution Control Board, on instructions, states that respondent no. 5 is having a valid consent to operate till 31st July, 2026.
3. In view of the stand taken by U.P. Pollution Control Board, we are of the opinion that the petitioner may approach the Board for redressal of his grievance. Respondent no. 4 would not be in a position to stop the running of the brick kiln in view of it having a valid consent to operate.
4. With the aforesaid observations, the petition stands disposed of. (Anish Kumar Gupta, J.) (Manoj Kumar Gupta, J.) Order Date :- 20.3.2025 Jaideep/- Digitally signed by :- JAIDEEP BANERJEE High Court of Judicature at Allahabad
