K NARSI REDDY The Court made the following: :: ORDER :: The above contempt case is filed complaining about the violation of the order dated 07.07.2017 in W.P.No.22478 of 2017. 2. The petitioner filed W.P.No.22478 of 2017 to declare the action of respondents 3 to 8 in trying to lay the road through the petitioner’s land of an extent of Ac.2.34 cents in Sy.No.35/3 and Ac.0.06 cents in Sy.No.33/2C of Settypalle Village, Gudipalle Mandal, Chittoor District, without following due process of law, as illegal and arbitrary. 3. The writ petition was disposed of, directing the respondent authorities not to lay a road through the petitioner’s land without following due process of law. 4. In the affidavit, in para No.7, it was pleaded about the order passed by the Joint Collector dated 21.04.2018. The copy of the order passed by the Joint Collector is filed as one of the material papers along with the contempt case. 5. As seen from the proceedings of the Joint Collector, it would indicate that the neighbouring people made a representation regarding the difficulties faced by them in reaching the burial ground. The Joint Collector, by exercising the powers conferred under Section 147 (3) of Cr.P.C., issued prohibitory SRS,J C.C.No.1570 of 2018 orders in respect of Sy.Nos.35/1, 35/2 and 35/3 of 115 of Settypalle Village, Gudupalle Mandal. The Joint Collector further directed the Tahsildar, Gudupalle, to take action for the subdivision of lands and its implementation in the records. 6. Since a speaking order was passed, this Court does not find any violation of the dated 07.07.2017 in W.P.No.22478 of 2017. 7. Given the facts and circumstances of the case, the Contempt Case is dismissed. However, it is open to the petitioner to challenge the order dated 21.04.2018, if aggrieved. No order as to costs.
