CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Ritesh Kumar Mahto, Advocate For the Respondent(s) : Mr. Mukesh Kumar Mehta, AC to G.P.-VI
…...... 03 / 23.01.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. Petitioner is seeking compassionate appointment against death of her grandfather- Shraban Mahli, who died on 07.03.2000. 3. Shraban Mahli, who was working on the post of chowkidar died in harness. His son applied for compassionate appointment, but after eleven years, he also died. No compassionate appointment was granted in relation to the death of Shraban Mahli though recommendation was made. This petitioner thereafter being the granddaughter applied for grant of compassionate appointment. 4. Admittedly, the compassionate appointment is being sought for on occasion of death of Shraban Mahli, who died on 07.03.2000. Compassionate appointment is granted to the family of the bread winner who dies in harness, to overcome the immediate financial crises. After passage of long period no compassion exists. In this case, today nearly twenty four years have elapsed after death of grandfather of this petitioner. The family has survived this long twenty four years, thus the very purpose of grant of compassionate appointment does not
remain now. The Hon’ble Supreme Court in the case of Fertilizers and Chemicals Travancore Ltd. and Ors. Versus Anusree K.B., reported in 2022 SCC OnLine SC 1331 has held that the whole object of granting compassionate appointment is to enable the family to tied over the sudden crisis. If such an appointment is made after a considerable period, the same will be against the object and purpose for which the appointment on compassionate ground is provided. 5. Now twenty four years have already elapsed, thus no compassionate remains it case. 6. At the time of death of the chowkidar- Shraban Mahli, this petitioner was only of nine years age. 7.
Considering what has been held above no case is made out for grant of compassionate appointment, accordingly, the instant writ petition stands dismissed. (ANANDA SEN, J.) R.S.
