PUBLIC PROSECUTOR The Court made the following: 2 SRK, J Crl.A.No.623 of 2007 J U D G M E N T: Complainant, in Calendar Case No.102 of 2005 on the file of the Judicial Magistrate of the First Class, Razole (for short ‘the learned Magistrate’) is the appellant. He filed the present Criminal Appeal challenging the Judgment dated 19.02.2007, whereunder and whereby the learned Magistrate acquitted the respondent No.1/accused of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (for brevity ‘the NI Act’), in terms of Section 251 (1) of the Code of Criminal Procedure, 1973 (for brevity ‘CrPC’). 2. Today when the matter is taken up for hearing, appellant/complainant is present. Sri V.V.Satish, learned counsel representing Sri A. Dattanand, learned counsel for the appellant/ complainant submitted that the respondent No.1/accused is no more and the appellant/complainant is not pressing the Criminal Appeal, as his grievance in the present Criminal Appeal does not survive. An endorsement to that effect is made by the learned counsel as well as the appellant. 3.
