This first anticipatory bail application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant who is apprehending her arrest in HARNEET KAUR Digitally signed by HARNEET KAUR Date: 2025.08.02 12:47:49 +0530 2 connection with Crime No. 140/2015 registered at Police Station – Balod, District – Balod (C.G.) for offence punishable under Sections 420 r/w 34 of IPC, Sections 3, 4 and 5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, Section 58B of Reserve Bank of India Act, 1934 and Section 10 of Chhattisgarh Protection of Depositors Interest Act, 2005. 2. Case of the prosecution, in brief, is that the applicant herein along with co-accused persons opened a Branch of Divyani Properties in Balod and through the medium of local agents, lured the general public and got the money deposited from them on the pretext of buying land and on the ground that their money will get doubled in 5 years, however, after the completion of 5 years, the money deposited by the people was not returned to them. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in this case as she became the Director of the said company on 22/01/2010 and resigned from the said post on 23/01/2010 whereas the offence is said to have taken place from April, 2013 to 16/04/2015, therefore, she is not involved in the commission of crime in question and she may be granted the privilege of anticipatory bail. 3 4. In compliance of order dated 25/07/2025 passed by this Court, learned State counsel has sought instructions and submits that applicant remained on the position of Director of Divyani Properties from 21/01/2010 to 23/01/2010 and she has been implicated in the offence in question on the basis of memorandum statement of co- accused Upendra Singh Tomar. He further submits that another offence bearing Crime No. 319/2016 has been registered against the applicant at Police Station Balod, therefore, she may not be granted the privilege of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case particularly considering that applicant remained as Director of the aforesaid company from 21/01/2010 to 23/01/2010 whereas the offence is said to have been committed from April, 2013 to 16/04/2015, I am inclined to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA application is allowed and it is directed that in the event of arrest of the applicant – Smt. Seema Chaudhari, on executing a personal bond of Rs. 25,000/- with one surety in the like sum to the 4 satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
