IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.11345 of 2022 ------ Puja Devi @ Puja Kumari aged about 30 years, Wife of Pintu Kumar, Resident of Sitala Mandir, Kankani Basti, Post Bansjora, Police Station Loyabad, District Dhanbad, State Jharkhand. .... .... …. Petitioner Versus 1. The State of Jharkhand 2. Gaya Choudhary S/o Ramchandra Chaudhary, R/o-Sudamdih, Simar Side, P.S.-Sudamdih, Dist.-Dhanbad. .... .... .... Opposite Parties ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Akhilesh Kr. Singh, Advocate For the State : Mr. Subodh Kr. Dubey, Addl.P.P. ------ Order No.06 Dated- 04/02/2025 Heard the parties. Apprehending his arrest in connection with Loyabad P.S. Case No.77 of 2020 instituted under Sections 341/342/356/382/385/386/ 420/34 and 120(B) of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner invited the informant to an under construction house and took the informant in a room and locked from inside and thereafter 8 to 10 persons came there and assaulted the informant, undressed him and made the video recording of the informant and took ATM and key of the vehicle of the informant and took Rs.20,000/- from his ATM and Rs.5,000/- from his Paytm and also snatched away the ring and gold chain and took out the cheque of Rs.40,000/- forcibly from the informant and demanded extortion of Rs.75,000/-. It is next submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-12 of this anticipatory bail application. Though, in Para-12 inadvertently the word “no” has wrongly been mentioned as “on”. It is next submitted that the main allegation is against the co-accused persons and there is no allegation of assault against the petitioner. It is also submitted that the petitioner undertakes that she will not annoy or disturb the informant or any of her family members in any manner during the pendency of the case. It is lastly submitted that the petitioner undertakes to co-operate with the investigation of the case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail. Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner. Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, she will be enlarged on bail on depositing cash security of Rs.10,000/- and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Dhanbad in connection with Loyabad P.S. Case No.77 of 2020 with the condition that she will co- operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish her mobile number and photocopy of the Aadhar Card with an undertaking that she will not change her mobile number and she will not annoy or disturb the informant or any of her family members in any manner during the pendency of the case and further conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
