27.08.2025 Item No.26 Ct.No.34 rc. Reject C.R.M. (M) 1017 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Onda Police Station Case No. 116 of 2024 dated 08.05.2024. And In Re : Sarjahan Khan @ Sirjahan @ Sajahan Khan ... Petitioner Mr. Ali Ashan Alamgir Syed uj Jaman Ms. Dona Saha Mr. S. Rahaman ... for the Petitioner Mr. Samarjit Balial ... for the State Memo of evidence submitted by the State is taken on record. The petitioner is in custody for about 15 months and prays for bail. Learned counsel for the petitioner submits that the charges are yet to be framed and the petitioner has been falsely implicated. His further detention is not required. Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner is the husband of the victim. Witnesses have implicated him in the alleged murder. The decomposed dead body of the victim was recovered pursuant to the leading statement of the petitioner. The petitioner is in custody for about 15 months. The offence, if proved, shall attract mandatory life imprisonment. Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage. The bail application is disposed of. Case Diary is returned. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.) 2
