IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No. 3 to consider his representation dt: 13.06.2025 for grant of permission and licence for construction and operation of 10 barges either built or brought in the Kakinada Anchorage Port pending disposal of the above Writ Petition and pass Counsel for the Petitioner:

ORDER:
The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a Writ of Mandamus or any other appropriate Writ, Order or direction declaring the action of the respondent No.3 in not taking any action on my representation dated 13.06.2025 for grant of permission and licence for construction and operation of 10 barges either built or brought in the Kakinada Anchorage Port, as illegal, arbitrary etc., and pass such other order…” (in verbatim)
2. The grievance of the petitioner is that he has submitted a representation dated 13.06.2025 to the 3rd respondent seeking permission and licence for 10 barges, either built or brought, which are intended for the export of rice. However, though more than two and a half months have elapsed, the 3rd respondent has neither responded nor taken any action on the said representation.
3. Learned Assistant Government Pleader for Roads and Buildings, appearing for respondent No.1, and Sri G. Subbarao, learned Standing Counsel for respondents Nos.2 and 3, have consented to the disposal of the writ petition with a direction to the 3rd respondent to consider and pass appropriate orders on the petitioner’s representation dated 13.06.2025.

4. Sri V.V.L.N. Sarma, learned counsel for the 4th respondent, submits that the objections raised by the 4th respondent may also be taken into
consideration before passing orders on the petitioner’s representation dated
13.06.2025. The petitioner has not objected to the same.

Considering the submissions made by learned counsel on both sides, this Writ Petition is disposed of at the admission stage, with a direction to the 3rd respondent to consider the petitioner’s representation dated 13.06.2025 and pass appropriate orders, taking into account the objections raised by the 4th respondent, and after providing an opportunity of hearing to the petitioner and the 4th respondent. The said exercise shall be completed within a period of two (2) weeks from the date of receipt of a copy of this order. No order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
