Petitioner has been made accused in connection with NDPS Case No.51 of 2024, arising out of Arki P.S. Case No. 37 of 2024, for the offences registered under Sections 8(c)/18/21(c)/22/25 of NDPS Act, pending in the court of Sri Rasikesh Kumar, learned Special Judge, NDPS, Khunti. On 02.08.2024 at about 03:10 pm, Arki Police on the basis of confidential information apprehended four persons including the petitioner and on search 4.163 kgs of opium were recovered from their possession. It was submitted that similarly situated co-accused has been granted bail by this court vide B.A. No. 10948/2024. Learned Special P.P. has opposed the prayer and submitted that co-accused was granted bail because nothing was recovered from his possession. Regard being had to the facts and circumstance of the case and considering the fact that commercial quantity of opium was recovered from the possession of the petitioner; I am not inclined to enlarge the petitioner on bail.
