JUSTICE RAJNESH OSWAL, JUDGE ORDER 02.03.2026 1) At the outset, Mr. Mohsin Qadiri, learned Sr. AAG submitted that though the life of the detention order has expired but still the appellants are aggrieved by the directions issued by the learned Writ Court, specifically those contained in paragraph 18 of the impugned judgment. He further submitted that the appellant no. 3 never intended to use disrespectful or objectionable language toward the Court; rather, the officer's sole intent in the dossier was to illustrate the conduct and antecedents of the respondent. LPA No.252 of 2025 2 | P a g e 2) Mr. Imtiyaz Hussain, the then SSP Srinagar has appeared before us through virtual mode and has expressed his regrets regarding the language employed in the dossier, submitting that there was never any intent to show disrespect to the Court. 3) In view of the above, as the officer has himself expressed remorse for his conduct, direction issued in para 18 of judgment dated 26.09.2025, whereby the Director General of Police has been directed to seek explanation with respect to the averments made in the dossier and initiate action against appellant no.3 for trying to demean the stature and integrity of judiciary and its judicial process, is set aside. Accordingly, the judgment dated 22.09.2025 passed by the Writ Court is modified to the extent aforesaid.
