Learned counsel for the petitioner submits that in the instant petition, the petitioner has assailed the legality, correctness and validity of the charge-sheet dated 15.11.2022 and suspension order dated 19.11.2022 issued by the respondents. He submits that the petitioner was placed under suspension in the year 2022 and he is being paid only 50% subsistence allowances. He submits according to the regulations which governs the service condition of the petitioner, the petitioner is entitled to 75% of the subsistence allowance. He further submits that for the present, he is restricting his claim with regard to making a representation to the respondents authority to consider the case of the petitioenr for revocation of his suspension and / or consider the payment of 75% of the subistence allowances and with this prayer he submits that the petitioner may be ASHISH TIWARI Digitally signed by ASHISH TIWARI Date: 2026.04.10 10:44:29 +0530 -2- permitted to make a detailed representation with regard to grievances as projected above to respondent No.1 who may be directed to decide the case in accordance with law. 2. This proposition is not opposed by Shri Shukla, Advocate. 3. In view of the above, the petition is disposed of at this stage permitting the petitioner to make representation before respondent No. 1 within a period of 30 days from the date of receipt of this order and respondent No.1, shall decide such representation filed by the petitioner within a period of 60 days from the date of receipt of such representation in accordance with law and procedure with regard to his grievances in respect to revocation of his suspension and / or payment higher subsistence allowance. 4.
