Balaji, who is confined at Central Prison, Vellore and set aside the same and direct the respondents to produce the detenu before this Court and set him at liberty. In both the HCPs, the mothers of the detenus, viz., Sutharsan, S/o Balaji (HCP No.1724 of 2025) and Bose @ Elangovan S/oSudhakaran (HCP No.1725 of 2025), branding them as Goondas under Section 2(f) of the Tamil Nadu Preventive Detention Act, 1982 (Tamil Nadu Act 14 of 1982) have challenged the detention orders, both dated 02.08.2025. 2. Prior to the order of detention, the detenus were arrested on 05.07.2025. The ground case relates to an offence under Section 123 of the Bharatiya Nyaya Sanhita, 2023 (BNSS). 3. We have heard Mr.D.Balaji, learned counsel for the petitioner in HCP 1724 of 2025, Mr.T.Arun, learned counsel appearing for 3/6 https://www.mhc.tn.gov.in/judis H.C.P.Nos.1724 and 1725 of 2025 Mr.T.Saravanan, learned counsel for the petitioner in HCP 1725 of 2025 and Mr.R.Muniyapparaj, learned Additional Public Prosecutor assisted by Mr.Sylvester John, learned counsel for the respondents. 4. One of the grounds of detention is based on the subjective satisfaction of the detaining authority that the detenus may be enlarged on bail, since, based on the information received by him, he states that the detenus intend to file bail application through their relatives. 5. It is unknown what the sources of information are, as the booklet provided does not contain the statement of any relative, or any other material for that matter to indicate that the detenus will be enlarged on bail. In such circumstances, the subjective satisfaction on the basis of which the detention orders have been passed, particularly the apprehension of the detaining authority that the detenus would be enlarged on bail, has no basis whatsoever. 6. In light of the aforesaid discussion, these Habeas Corpus Petitions are allowed and the Detention Order passed by the second respondent in B3/D.O.No.66/2025, dated 02.08.2025 (HCP No.1724 of 2025) and B3/D.O.No.67/2025, dated 02.08.2025 (HCP No.1725 of 2025) are set aside. 7. The detenus, viz., Sutharsan, S/o. Balaji, aged 22 years, who is now confined in Central Prison, Vellore, and Bose @ Elangovan, S/o. 4/6 https://www.mhc.tn.gov.in/judis H.C.P.Nos.1724 and 1725 of 2025 Sudhakaran, aged 23 years, who is now confined in Central Prison, Vellore are hereby directed to be set at liberty forthwith unless their presence is required in connection with any other case.
