Heard the parties.
The petitioners have been made accused in connection with Lesliganj P.S. Case No. 83 of 2024, S.T. Case No.467 of 2024, for the offences registered under Sections 189(5), 190, 191(2) & 103(1) of Bharatiya Nyaya Sanhita, pending in the court of Sri Shankar Kumar Maharaj, learned Additional Sessions Judge-III, Palamau at Daltonganj.
On 15.07.2024, a bus bearing registration No. JH03Y-5671 dashed a tempo, due to which, two passengers died and several passengers were injured. It is further alleged that a mob of several persons set the bus on fire and assaulted the driver due to which, he succumbed to the injuries.
It was submitted that petitioners are not named in the F.I.R. It was further submitted that there is general and omnibus allegation against all the accused persons and several co-accused persons have been granted bail by this Court earlier.
Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Sri Shankar Kumar Maharaj, learned Additional Sessions Judge-III, Palamau at Daltonganj, in connection with Lesliganj P.S. Case No. 83 of 2024, S.T. Case No.467 of 2024.
