Mr. R.C. Tamta, learned counsel for respondent No.4. 4. Delay in filing the counter affidavit is condoned. Counter affidavit filed by the State is taken on record. Delay Condonation Application (IA/2/2025) made therefor, is allowed. 5. By means of the present criminal writ petition, the petitioner has put to challenge the impugned FIR No.42 of 2023 dated 06.02.2023, for the offences punishable under Section 420 IPC and under Section 66D of the Information Technology (Amendment) Act, 2008, registered with P.S. Sitarganj, District Udham Singh Nagar. 6. The interim order was passed in favour of the petitioner only on the premise that the petitioner made a statement before this Court that he was ready to pay the amount under dispute to the respondent No.4. But, despite several opportunities, the amount under dispute has not been paid by the petitioner to the 2025:UHC:4966 respondent No.4. This is nothing but playing fraud upon the proceedings of the Court. 7. Learned State Counsel on instruction submits that after investigation, charge- sheet has been submitted against the petitioner on 12.04.2025. 8. In view of the above facts, the present criminal writ petition has rendered infructuous. Accordingly, the same is dismissed as infructuous. However, it is open to petitioner to challenge the charge- sheet in appropriate proceedings before the appropriate forum. 9. Interim order dated 28.02.2025 stands vacated. 10. Pending application(s), if any, also stands disposed of.
