The facts leading to filing of the present Writ Petition are as follows: The Petitioner is an adopted son of one Thuruka Chandra Mouli, S/o Malakondaiah. The said Chandra Mouli, while working as an Assistant Mechanic in APSRTC, Sullurpeta Depot, had died on 27.04.2020. The petitioner, being the nominee in the books of SBT (Staff Benevolent-cum-Thrift Fund), had received the death benefits. The Petitioner had submitted an application on 04.08.2021 to the Respondent for compassionate appointment, as he was unable to take care of himself after the Authorities to consider his case 3 death of his father. However, the Respondent Authorities rejected the said application through orders dated 23.08.2023. Hence, the present Writ Petition. 3. Learned counsel for the Petitioner would submit that the father of the Petitioner had died during the Corona pandemic period, and as per the judgment of the Supreme Court in Suo Motu Writ Petition (C) No. 3 of 2020, dated 10.01.2022, there is an exemption excluding the period from 15.03.2020 to 20.02.2022 for computing the period of limitation. He further submits that if this period is excluded, the application of the Petitioner would be within the time prescribed, and this aspect was not noted by the Respondent Authorities while passing the impugned Order. 4. Learned Assistant Government Pleader would submit that the application of the Petitioner was rejected on the ground that the time fixed for filing the application is one year from the date of death of the deceased, but the Petitioner filed the application beyond one year. Having heard the respective counsel and taking note of 5. 4 the Judgment of the Hon’ble Apex Court in Suo Motu Writ Petition © No.3 of 2020, dated 10.01.2022, excluding the period from 15.03.2020 to 20.02.2022 for computing the period of limitation, the application of the Petitioner ought to have been examined on merits rather than rejecting the claim of the Petitioner by the Respondent Authorities. Therefore, the impugned Proceedings dated 23.08.2023 are set aside. 6. Accordingly, the Writ Petition is disposed of directing the Respondent Authorities to examine the application of the Petitioner dated 04.08.2021 for compassionate appointment afresh on merits within a period of one (01) month from the date of receipt of a copy of this Order.
