Bhag Chand v. State of Himachal Pradesh and Ors.
CMP-T No. 56 of 2025 in Execution Petition No. 1 of 2022
21.5.2025 Present: Mr. Daleep Singh Kaith, Advocate, for the applicant/petitioner.
Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C. Verma, Additional Advocates General with Mr. Ravi Chauhan, Deputy Advocate General, for the respondents.
Bare perusal of reply filed by the respondents in the application at hand, clearly reveals that respondents, after having considered case of the petitioner, have passed a detailed speaking order, perusal whereof suggests that claim of the petitioner has been considered and allowed. Office of Accountant General has also issued PPO No. 1123274202 in favour of the petitioner, thereby authorizing pension w.e.f. 1.1.2018, as such, there is nothing to suggest that mandate contained in the judgment sought to be executed, has not been complied with.
Since mandate contained in the judgment sought to be executed has been duly complied with, nothing remains to be adjudicated in the instant application and accordingly, same is disposed of. However, directions are issued to the respondents to ensure that arrears on account of pension, which have been authorized in favour of the petitioner w.e.f. 1.1.2018, if not already paid, are paid, expeditiously, preferably, within three months.
