PUBLIC PROSECUTOR (AP) 2 Crl.A.No.829 of 2017 The Court made the following JUDGMENT :- (Per the Hon’ble Sri Justice K.Suresh Reddy) Questioning the conviction and sentence passed by the learned III Additional Sessions Judge, (FTC) Ananthapuramu, dated 01.02.2017 in S.C.No.455 of 2015, the sole accused filed the present Criminal Appeal under Section 374(2) of Code of Criminal Procedure, 1973. 2. On 12.02.2025 when the appeal was listed for hearing, learned counsel for the appellant stated that the whereabouts of the appellant were not known. He has also stated that he has vague information that the appellant died. In view of the said statement, learned Additional Public Prosecutor was requested to find out the whereabouts of the appellant. 3. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor furnished written instructions issued by the Inspector of police, Ananthapuramu Rural Police Station, in which it is stated that during pendency of the present appeal, the appellant died on 12.07.2024 due to heart attack at Government Hospital, Tadipatri. 4. In that view of the matter and in view of the death of the appellant, the Criminal Appeal is liable to be dismissed as abated. 3 Crl.A.No.829 of 2017 5. Accordingly, the Criminal Appeal is dismissed as “abated”. Consequently, miscellaneous petitions, if any, pending shall stand closed.
