The petitioner claims to be the wife of one Marut Kumar Dubey who was posted in BSF CT (Crew) Wing at Assam. The said Marut Kumar Dubey died on March 15, 2025. The petitioner alleges that two certificates both bearing the issuing date of April 17, 2025 have been issued by the self- same authority. Learned advocate appearing for the petitioner submits that in one of the death certificates the name of the petitioner has been recorded as the spouse of the 2 deceased while in the other one the name of the spouse has not been mentioned. Petitioner alleges that the death certificate bearing the name of the petitioner as the spouse is the original one and the other is not a genuine one. Petitioner claims to have submitted a representation before various authorities including the District Registrar (Birth & Death), Sagardighi Sqare, Cooch Behar, being the 4th respondent herein, praying for cancellation of the death certificate digitally signed on August 26, 2025 and for restoring the one which has been digitally signed on April 24, 2025. Learned advocate appearing for the petitioner submits that though a representation dated April 27, 2026 has been submitted before the concerned respondent authority, the decision on such representation has not yet been communicated to the petitioner till date. Heard the learned advocate appearing for the State. She submits that the decision on such representation shall be communicated to the petitioner within the time limit as may be fixed by this Court. 3 Without entering into the merits of the claim made by the petitioner in the representation dated April 27, 2026, this writ petition stands disposed of by directing the District Registrar (Birth & Death), Sagardighi Sqare, Cooch Behar, being the 4th respondent herein, to consider the representation of the petitioner dated April 27, 2026 and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner and any other person who may be affected by such decision or their authorized representative and communicate the reasoned order to the petitioner as expeditiously as possible. The entire exercise shall be completed expeditiously and positively within a period of four weeks from the date of receipt of a server copy of this order together with a copy of the representation dated April 27, 2026 and the photocopies of the death certificates annexed at pages 16 and 17 of the writ petition.
