PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition u/Sec.480 and 483 of B.N.S.S. has been filed by the petitioner/A4 seeking regular bail in Cr.No.304/2024 of Anakapalle Rural Police Station, Anakapalle District. 2. The above said crime was registered against the petitioner and others for the offence punishable u/Sec.20(b)(ii)(C), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. The case of the prosecution is as follows: On 03.12.2024 at about 3.30 pm, on receipt of credible information about illegal possession and transportation of ganja, the S.I of police, along with his staff and mediators rushed to Vooderu junction, Anakapalle Mandal and conducted vehicle checking. They found one Maruti Ertiga 2 Car bearing registration no.AP 39 B 3334. On seeing police, the inmates in the car stopped the car and tried to fled away. Then police apprehended them and on enquiry, they disclosed their identity particulars as that of A2 to A4 and police found 100 kgs of ganja in their possession. After observing all formalities, the accused were arrested, seized the contraband and the vehicles and got remanded the accused to judicial custody. 4. Learned counsel for the petitioner contended that the petitioner is in judicial remand from 03.12.2024 and approximately 100 days completed and prays to grant bail. 5. On the other hand, learned Assistant Public Prosecutor confirms non-filing of charge sheet by the police and opposed for grant of bail to the petitioner by stating that the contraband involved is huge quantity. 6. Heard both sides. 7. Perused the entire material on record. 8. Without going into the merits of the case, as the contraband involved is 100 kgs which is a huge quantity and as per the bar contained in section 37 of the NDPS Act, this Court is not inclined to consider the criminal petition at this stage. 9.
