GP FOR FINANCE PLANNING JS,J W.P.No.23989 of 2024 2 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a Writ, Order, or Direction more particularly one in the nature of writ of mandamus or any other appropriate writ or direction declaring the action of the respondents in not releasing the payments for the works i.e., i) C & C of Rayakuduru-I L.1 Scheme on left bank of Basavaraju Codu Drain in Veeravasaram Mandal of West Godavari District on turn key basis including operations of the scheme for 2 years through the Agreement No./2016-17, dated 13.04.2016 for an amount of Rs.6,72,638/- and ii) C & C Rayakuduru-II L.1 Scheme on right bank of Gonteru Drain in Veeravasaram Mandal of West Godavari District on turn key basis including operations of the scheme for 2 years through the Agreement No./2016-17, dated 13.04.2016 for an amount of Rs.3,33,512/- totaling an amount of Rs.10,06,150/- as illegal, arbitrary and violative of Articles 14 and 21 of Constitution of India and consequently direct the respondent authorities to release Rs.10,06,150/- for the pending bills forthwith for the above said works executed by the petitioner and pass such order or orders ……….” 2. Heard learned counsel for the petitioners as well as learned Government Pleader for Finance and Planning appearing for respondent Nos.2, 4 and 8. 3. Today, when the matter came up for hearing, learned Government Pleader for Finance, placed on record the written instructions given by the Principal Secretary to Government, Finance Department, A.P. Secretariat, Velagapudi, wherein it is stated that two bills Nos.2024-714986 and 2024-637486 for Rs.6,72,638/- and JS,J W.P.No.23989 of 2024 3 Rs.3,33,512/- respectively were processed for payment and they will be cleared on priority basis. 4. Recording the aforesaid submission, the Writ Petition is disposed of directing the respondents to clear the bills Nos.2024- 714986 and 2024-637486 for Rs.6,72,638/- and Rs.3,33,512/- respectively, and release the amounts, within a period of one (1) month from the date of receipt of a copy of this order, with interest at 12% p.a. The interest shall be computed from the date of expiry of one month from the date of submission of the bills by the petitioners till the date of payment. No order as to costs.
