PENJURI VENUGOPAL Counsel for the Respondent(S): 1. 3 THE HONOURABLE SMT JUSTICE V.SUJATHA CIVIL REVISION PETITION NO: 3006/2024 ORDER: This Revision Petition is filed questioning the inaction on the part of the Junior Civil Judge, Mydukur, in not disposing of I.A.No.2029 of 2022 in O.S.No.226 of 2022 filed seeking to permit the petitioner to implead the proposed respondent Nos. 6 to 8 and amend the prayer. 2. It is brought to the notice of this Court that the petitioner has filed the above suit against the respondents/defendant Nos.1 to 5, seeking specific performance with respect to the suit schedule property basing on the sale agreement dated 17.08.2020 executed by the late P.Subba Reddy in his favour. 3. Before filing of the said suit, the petitioner got issued legal notice dated 03.01.2022 to all the respondents and after receiving the said notice, the 5th respondent colluded with the proposed party No.6 who belongs to Proddutur and executed a nominal registered sale deed No.3775 of 2022 dated 14.02.2022 in his favour. As on the date of filing of the suit, the petitioner was not aware of the said impugned sale deed as such, he filed I.A.No.2029 of 2022 requesting the Court below to implead the proposed respondent Nos. 6 to 8 as defendant Nos. 6 to 8 in the above suit who are the other subsequent purchasers and revenue department and also for consequential amendments for proper adjudication of the above suit. 4. The complaint of the petitioner before this Court is that the Trial Court is not convincing any interest in the disposal of I.A.No.2029 of 2022 in O.S.No.226 of 2022, which is causing irreparable loss to the petitioner. 4 5. As the I.A.No.2029 of 2022 is of the year 2022, there is a chance of delay in disposing of the main suit itself. In view of the same, instead of keeping the present revision pending, this Court feels it appropriate to dispose of the same by directing the Junior Civil Judge, Mydukuru, to dispose of the I.A.No.2029 of 2022 in O.S.No.226 of 2022, if not yet disposed of, in accordance with law within a period of three (3) months from the date of receipt of copy of this order. 6. Accordingly, the Civil Revision Petition is disposed of. There shall be no order as to costs.
