Neutral Citation No. - 2025:AHC:48479 Court No. - 5 Case :- WRIT - A No. - 3745 of 2025 Petitioner :- Shashi Kamal Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Saurabh Kumar Counsel for Respondent :- Abhishek Srivastava,C.S.C. Hon'ble Ajay Bhanot,J. The petitioner claims that his case on compassionate ground appointment has not been decided till date. A representation in this regard has been made to the competent authority but to no avail. The only prayer made by Shri Ramesh Chandra Agrahari,
learned counsel holding brief of Shri Saurabh Kumar,
learned counsel for the petitioner is that the representation of the petitioner for grant of appointment on compassionate ground be decided within a stipulated period of time. Ms. Kritika Sinha, learned counsel holding brief Shri Abhisehk Srivastava, learned counsel for the respondent nos. 2 and 3 and learned Standing Counsel submit that the matter requires factual determination including the financial status of the family and other considerations as per applicable laws and Government Orders by the competent authority in the first instance. However, he fairly contends that the purpose of appointment on
compassionate ground will be defeated in case the same is not processed in a reasonable period of time. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 4 is
directed to decide the representation of the petitioner for grant of appointment on compassionate ground as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
