01.08.2025 Court No.28 Item No.35 tbsr Reject CRM (A) 2381 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bagnan P.S. Case No.408 of 2019 dated 29.09.2019 under Sections 3 and 4 of the Explosive Substances Act. And
In the matter of: Nitai Parui
….Petitioner. Mr. Dipta Dipak Banerjee
…for the petitioner.
Mr. Iqbal Kabir Ms. Debjani Sahu
…..for the State
Learned counsel appearing on behalf of the petitioner submits that he has been falsely implicated in this case.
Learned counsel appearing on behalf of the State submits that the prayer for anticipatory bail of a similarly circumstanced co- accused was rejected by this Court earlier. Huge quantity of explosive substances were recovered from the house of the present petitioner. The petitioner has been absconding for seven years now.
Considering the incriminating materials available in the case diary, the fact that similarly circumstanced co-accused was denied the benefit of anticipatory bail and the fact that the petitioner has been absconding for long, I do not consider this to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
