UNNI KRISHNAN NAIR ORDER Date : 27.04.2026 Heard Mr. P S Bhattacharya, Learned Counsel for the Petitioner. Also heard Mr. A D Choudhury, Learned Counsel appearing for the sole respondent. The present Review Petition has been instituted praying for review the order dated 27.06.2024, passed by this Court in WP(C)/5347/2020, as well as the order dated 02.09.2024, passed in I.A(C)/2617/2024 (arising from WP(C)/5347/2020), to the extent to the payment of interest, as directed by this Court, for the arrear amount, receivable by the sole respondent, herein. I have heard the learned counsel for the parties and perused the materials available on record. This Court, vide order dated 27.06.2026, had, by appreciating the fact that an amount of Rs. 2,03,660/- (Rupees Two Lakh Three Thousand Six Hundred Sixty Only) was due to the respondent society and the said amount was not disputed by the petitioners, herein, and for which a pre- receipt was also submitted by the petitioners, had directed for release of Page No.# 3/4 the said amount of Rs. 2,03,660/- (Rupees Two Lakh Three Thousand Six Hundred Sixty Only), along with interest at the rate of 9% per annum, from the date the, said amount was due for payment. A specific date, from which the interest payable was to be computed, not having been mentioned by this Court, in the order dated 27.06.2024, the sole respondent, herein, had instituted an Interlocutory Application being I.A(C)/2617/2024, seeking clarification in the matter. This Court vide order dated 02.09.2024, had clarified that the amount of interest, that would now be payable to the petitioner, on the admitted amount of Rs. 2,03,660/- (Rupees Two Lakh Three Thousand Six Hundred Sixty Only), on account of the delay of payment of the same, would be at the rate of 9%, w.e.f 22.08.2013. It is submitted that the admitted amount of Rs. 2,03,660/- (Rupees Two Lakh Three Thousand Six Hundred Sixty Only), has been released to the petitioner after the passing of the order dated 02.09.2024 in I.A(C)/2617/2024. However, the interest amount was not paid and the present review petition has been instituted. This Court has perused the contentions raised by the petitioners in the present review petition and finds that no material has been brought on record, towards highlighting any error in the orders, review of which is being sought for. The materials, available on record, reveals that there is no dispute, with regard to the claim of the sole respondent that an amount of Rs. 2,03,660/- (Rupees Two Lakh Three Thousand Six Hundred Sixty Only), was due to it and a pre-receipt for the same was also submitted. The only reason assigned by the review petitioners for justifying the delay, occasioning in release of the said amount, was that the processing, involved, had taken some time. In view of the fact that no error has been highlighted to be existing, in the order, review of which has been sought for, this Court is of the considered view that by way of filing the present review petition, the petitioners have sought for a re-hearing in the matter which is clearly impermissible. Page No.# 4/4 Accordingly, the present review petition stands dismissed. The orders dated 27.06.2024, passed in WP(C)/5347/2020 and order dated 02.09.2024, passed in I.A(C)/2617/2024, is affirmed.
