The petitioner alleges arbitrary action on the part of the respondent CESC authorities in not providing electricity connection to the petitioner’s shop room. 2. The order dated October 27, 2025 passed by a Coordinate Bench of this Court records that postal articles sent to the respondent no.5 were returned with the endorsement “refused”. 3. Ms. Mitra, learned advocate appearing for the CESC authorities submits that the petitioner could not be supplied electricity connection at the petitioner’s shop room for technical reasons inasmuch as the petitioner’s shop room is too small for a meter to be installed thereat. It is submitted that CESC authorities can effect supply by installing a meter at the existing meter board position. 4. It is noticed that by the order dated February 13, 2026, the petitioner had been directed to provide an alternative location for the meter to be installed. 5. Today, Mr. Halder, learned advocate appearing for the petitioner submits that if the meter is installed at the existing board position, the petitioner would have no objection inasmuch as the petitioner has no alternative space for meter installation to suggest. 6. In such view of the matter, this writ petition is disposed of by directing the CESC authorities to grant fresh electricity connection to the petitioner by installing a meter in the name of the petitioner at the existing meter board position within a period of two weeks from the date of compliance of all formalities including payment of requisite charges, if any, by the petitioner. 7. It is jointly submitted by Mr. Halder and Ms. Mitra that the private respondent i.e. the respondent no.4 might raise objection and put up resistance in CESC Authorities executing the work of effecting electricity supply to the petitioner’s shop room. 8. In such view of the matter, the CESC authorities shall be at liberty to approach the jurisdictional police officer for the purpose of seeking police assistance. 9. The respondent no.3 i.e. the officer-in-charge, Parnasree Police Station is directed to provide police assistance to the CESC authorities for the 2 purpose of enabling the CESC authorities to execute the work of effecting electricity supply at the petitioner’s shop room by installing meter at the existing meter board position at the relevant premises. The petitioner shall bear the costs for police assistance. 10. In case, the meter room is locked the police authorities would be entitled to break open the padlock in the presence of the private respondent only to enable the CESC authorities to install electricity connection at the existing meter board. It is clarified that padlock should be broken only if it has been put on the meter board position and not elsewhere. 11. With the aforesaid observations, WPA 9172 of 2025 stands disposed of. 12. There shall be no order as to costs. 13. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.) 3
