GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 2nd and 3rd respondent in not registering crime the complaints dated 20.01.2025 and 02.08.2025 lodged by the petitioner and thereby allowing 4 respondent to make repeated attempts of trespass into an extent of 2 Ac. 1.03 Cents of the land situated in Sy.No 349, Sy.No. 350 and Sy.No. 350-2A1 of Gollapalli Village, B.Kothakota Mandal Annamayya District, is illegal, arbitrary, unjust and violation of Articles 14, 21 and 300-A of the constitution of India and consequently direct 3rd respondent to register the crime by taking the complaints dated 02.08.2025 and provide police protection to implement the orders of the Hon'ble 1st Additional Junior Civil Judge, Madanapalli dated 22.01.2025 in I.A.No. 21 of 2025 in O.S.No. 38 of 2025.” 2. Sri M.Venkata Ramana Reddy, learned counsel for the Petitioner would submit that they have filed a suit in O.S.No.38 of 2025 for permanent injunction and also obtained ad-interim injunction in his favour against the unofficial Respondent in I.A.No.21 of 2025 in O.S.No.38 of 2025, dated 22.01.2025. The said injunction has been extending from time to time. Learned counsel would further submit that, even after filing of counter by the unofficial Respondent herein in the said petition, the interim was extended by the learned trial Judge until further orders vide docket order dated 24.07.2025 and the matter is coming up for enquiry. Meanwhile, the unofficial Respondent is trying to damage the Tomato crop in the field of the Petitioner, who is in possession and enjoyment of the said property. Learned counsel would submit that the Petitioner has approached the Police and submitted a representation seeking Police protection, but the Police have not responded to his representation to protect his property. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, since the civil suit is pending between the parties and the matter is of civil nature, they have not given any protection and that they are ready to obey the orders of this Court. 3 4. In the light of the interim injunction order which is in favour of the Petitioner as on this day, the Writ Petition is disposed of, directing the Police to consider the representation of the Petitioner and take appropriate steps according to law to protect the property of the Petitioner so long as the injunction is in their favour. There shall be no order as to costs.
