JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 3 18-03-2026 Heard learned counsel for the petitioner and the State. 2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 74, 109, 352, 351(2) and 351(3) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act. 3. The prosecution case, in brief, is that on 04.12.2024 at about 12:45 in the midnight, all the F.I.R. named accused persons, including this petitioner, misbehaved with the dancers who were dancing in the marriage function of informant’s cousin and on being objected, co-accused Saroj Yadav and Anuj Kumar opened fire causing firearms injury in the right hand of informant. 4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has Patna High Court CR. MISC. No.18733 of 2025(3) dt.18-03-2026 2/2 committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of causing firearms injury is against co-accused Saroj Yadav and Anuj Kumar and there is no allegation that this petitioner caused any firearms injury to anyone. There is general and omnibus allegation against this petitioner. 5. Learned A.P.P. for the State vehemently opposed the bail application. 6. Considering backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P. S. Case No. 470 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Navya/- (Prabhat Kumar Singh, J) U T
