The Petition prayer reads as under: “In furtherance of the facts bought to light, provisions of law canvassed and precedents cited, the Petitioner most humbly pray to this Hon’ble Court to: 1. Issue notice to the O.P.’s by admitting this Writ Application: 2. Set aside the order Dt. 21.10.2024 in S.A. No. 69 of 2024 vide Annexure-3 passed by the Ld. DRT for being vague, perverse, arbitrary and illegal 3. To pass any other orders in the interest of justice, equity and good conscience as this Hon’ble Court deems fit in the given set of facts and circumstances.” Petitioner is an auction buyer of a security property in the process constituted under the provisions of SARFAESI Act, 2002. The grievance is against the interim order granted by the DRT, Cuttack in pending S.A. No. 69 of 2024. All the learned Advocates graciously agreed with the suggestion of this Court that Petitioner be arrayed as one of the Respondents to the pending S.A. and that the S.A. be finally heard and disposed off by the DRT with the participation of all the stakeholders preferably within an outer limit of eight weeks, all contentions for that purpose having been kept open. Ordered accordingly and Writ Petition is disposed off. The OP-borrower shall move a formal application before the DRT for impleading the Petitioner herein as Respondent as mentioned above on war footing and that the Bank shall not object to the said application.
