The learned counsel for the petitioner contends that the petitioner's mother was appointed Fair Price Shop Dealer for the subject shop and she had passed away on 06.12.2023. After her death, the petitioner took charge as dealer of the Fair Price Shop No.0510005, situated in Dharmajigudem Village, Lingapalem Mandal, Eluru District. 4. Learned counsel for the petitioner relies on G.O.Ms.No.04, dated 28.02.2014, and submits that the petitioner has made an application seeking appointment as a Fair Price Shop Dealer on compassionate grounds. However, the said application has not yet been disposed of. 5. Learned counsel for the petitioner relies on the decisions of this Court in Smt. Peddisetti Anitha Sree Yenapalli Anitha Sree vs. State of Andhra Pradesh1 and prayed for a direction to consider the petitioner’s case in terms of the said order. 6. Learned Assistant Government Pleader for Civil Supplies appearing for the respondents contended that the petitioner's application was incorrectly submitted to the Mandal Revenue Officer, whereas, as per the Government Order, it should be made to the Revenue Divisional Officer (RDO), the 2nd respondent. 7. Considering the contentions advanced, this Court is of the considered view that, as noted from the material papers filed along with the writ petition, the application of the petitioner was submitted to the Tahsildar-3rd respondent 1 Manu/AP/0072/2022 and no application was filed before the Revenue Divisional Officer (RDO), who is the appropriate authority to consider the grievance of the petitioner. The petitioner is permitted to file a fresh application, annexing all required documents, to the appropriate authority (RDO) within two weeks from the date of receipt of this order. Upon filing of such application, the RDO/appropriate authority shall dispose of the matter within four weeks thereafter, after providing an opportunity of hearing to the petitioner. 8. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
