THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners have sought for the following reliefs:- “i) To call for records relating to FIR in Crime No.72/2024 from the file of the 1st Respondent U/s 3,4 of Dowry Prohibition Act 1961, and U/s 506, 34, 498A, 504 of Indian Penal Code 1860. ii) Quash the Complaint and subsequent FIR lodged by the Respondent Police in Crime No.72/2024 dated: - 3 - NC: 2025:KHC:4487 CRL.P No. 9321 of 2024 14.03.2024 U/s3, 4 of Dowry Prohibition Act 1961, and U/s 506, 34, 498A, 504 of Indian Penal code 1860. iii) Lodged by the Respondent No.2, produced as ANNEXURE-D and E as it is not maintainable. iv) And to pass any such orders, this Hon’ble court thinks fit in the interest of justice and equity.” 2. Learned counsel for the petitioners – accused Nos.1 to 4 and learned counsel for respondent No.2 - complainant have filed a Joint Memo dated 30.01.2025 duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioners – accused Nos.1 to 4, respondent No.2 and their respective counsel are physically present before the Court and they admit the contents of the Joint Memo, which reads as under:- “JOINT MEMORANDUM FILED BY THE PETITIONERS AND 2ND RESPONDENT AND DE FACTO COMPLAINANT. “1. The Petitioners are the accused in Cr.No.72/2024 filed by the respondent No.2, defacto Complainant under section 498A, 504, 506 of IPC and 3 and 4 of D.P. Act against husband, in law and brother in law. 2. The 1st petitioner and 2nd Respondent filed a mutual consent Divorce petition in M.C.No.4624/2024 before Hon’ble Principal Family Judge, Bengaluru, as per the - 4 - NC: 2025:KHC:4487 CRL.P No. 9321 of 2024 Memorandum of Settlement, the 2nd respondent to agreed to co-operate to quash the criminal proceedings in Crl.Petition No.9321/2024. 3. The 2nd respondent had received a sum of Rs.27,00,000/- (Twenty Seven Lakhs only) as permanent alimony in M.C.No.4624/2024. 4. 1st Petitioner Rangaraj have paid Rs.27,00,000/- to 2nd Respondent Mrs.Veena vide following DDs from Union Bank of India DD.No.474568 for Rs.5,00,000/- dated 07.06.2024 and Union Bank of India DD.No.474651 for Rs.5,00,000/- dated 16.09.2024 and Union Bank of India DD. Bearing No.52474790 for Rs.17,00,000/- dated 18.01.2025. The above payments are received by the 2nd Respondent. In view of settlement the quashing petition may be quashed in the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Memorandum dated 30.01.2025. - 5 - NC: 2025:KHC:4487 CRL.P No. 9321 of 2024 (ii) The proceedings in Crime No.72/2024, registered by respondent No.1-Police, for the offences punishable under Sections 3 and 4 of the Dowry Prohibition Act, 1961 and under Sections 506, 498-A and 504 of IPC, insofar as the petitioners are concerned are hereby quashed.
