GP FOR FINANCE PLANNING The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking a declaration that the action of the Respondents in not refunding the EMD amount of Rs.3,30,449/- to the petitioner, even after completion of the work “Pulivendula Municipality-PADA Grants 2023-24 -Laying of CC Roads and Restoration of Damaged Existing CC Roads in Ramalaya Temple, Yarramreddypalle road of Chinnarangapuram in Pulivendula Municipality”, executed under Agreement No.79/202324, dated 11.10.2023 is illegal, arbitrary unreasonable contrarty to the terms and conditions mentioned in the agreement and violative of Articles 14, 16 and 21 of Constitution of India. 2. Today, when the matter came up for hearing, learned counsel appearing for the petitioner submitted that the first installment of EMD had already been paid and therefore sought permission of this Court to withdraw this writ petition with a liberty to file a fresh writ petition if there is any grievance with regard to payment of the second installment of EMD in the future. 3. Permission is accorded. 4. Accordingly, this Writ Petition is dismissed as withdrawn, granting liberty to the petitioner to file a fresh writ petition if at all there is any grievance with 3 regard to the payment of the second installment of EMD in the future.
